These Terms of Service ("Terms") govern your use of the Memory Magnets website and the purchase of products from us. By using our website or placing an order, you agree to be bound by these Terms.

2. Eligibility

By placing an order, you confirm that you are at least 18 years old or have the permission of a parent or legal guardian.

3. Products

All of our products are made to order and personalised to your specifications.

Whilst we make every effort to display colours, designs and layouts accurately, slight variations may occur due to screen settings, printing processes and manufacturing tolerances. Such variations do not constitute a fault.

4. Personalisation

You are responsible for ensuring that all information submitted for personalisation is accurate before placing your order, including but not limited to:

• Names

• Dates

• Spellings

• Messages

• Uploaded photographs

• Artwork or other personalised content

We cannot accept responsibility for errors resulting from incorrect information supplied by you.

By uploading photographs, artwork or other content, you confirm that:

• you own the content or have permission to use it;

• it does not infringe any copyright, trade mark, privacy or other third-party rights; and

• it does not contain unlawful, offensive or defamatory material.

We reserve the right to refuse any order containing content we reasonably consider inappropriate or unlawful.

5. Prices and Payment

Our base prices are set in Pounds Sterling (£GBP).

Where available, prices may be displayed in your local currency using Shopify's automatic currency conversion based on your location. These converted prices are provided for convenience and are calculated using exchange rates determined by Shopify.

The final price payable, including any applicable taxes and shipping charges, will be displayed during checkout before you complete your purchase.

Exchange rates may fluctuate, meaning prices shown in your local currency may change over time.

Payment must be made in full before production of your personalised order begins.

6. Order Acceptance

After placing an order, you will receive an acknowledgement email confirming that we have received it. This email does not constitute acceptance of your order.

A contract between you and Memory Magnets is formed only when we send you an email confirming that your order has been accepted.

We reserve the right to refuse or cancel an order before acceptance where, for example:

• the requested personalisation is unlawful, offensive or infringes third-party rights;

• there has been a pricing, technical or typographical error;

• payment cannot be authorised;

• we reasonably suspect fraudulent activity; or

• we are unable to fulfil the order.

If payment has already been taken for an order that is not accepted, we will issue a full refund.

7. Production and Delivery

Estimated production and delivery times are provided for guidance only and are not guaranteed.

While we aim to dispatch all orders within the estimated timeframe, delays may occur due to circumstances beyond our reasonable control, including courier delays, severe weather, customs processing or supplier issues.

We shall not be liable for delays that are outside our reasonable control.

Risk in the products passes to you upon delivery.

8. International Orders

If you order products for delivery outside the United Kingdom, your order may be subject to import duties, taxes, customs fees or other charges imposed by the destination country.

Unless expressly stated otherwise at checkout, these charges are your responsibility. We are not responsible for customs delays or charges imposed by overseas authorities.

9. Personalised Products

All products sold by Memory Magnets are made to your individual specifications and are clearly personalised.

Accordingly, they are exempt from the standard 14-day cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

10. Faulty or Incorrect Products

If your order arrives damaged, faulty or does not match the personalisation details you submitted, please contact us as soon as reasonably possible.

Nothing in these Terms limits or excludes your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

11. Intellectual Property

All website content, product designs, graphics, logos, photographs, text and other intellectual property remain the property of Memory Magnets or our licensors unless otherwise stated.

You may not reproduce, distribute or use our content without our prior written permission.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence.

Subject to the above, our total liability arising from any claim relating to your order shall not exceed the amount paid for that order.

We shall not be liable for indirect or consequential losses except where such limitation is prohibited by law.

13. Privacy

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information in accordance with UK data protection legislation.

14. Changes to These Terms

We may amend these Terms from time to time.

The version published on our website at the time your order is accepted will apply to that purchase.

15. Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
